2018 Municipal Election

The next Municipal Election will be held on October 22, 2018 to elect a Regional Chair for the Regional Municipality of Halton.

This information is a starting point but it is not exhaustive. Be sure to check this page frequently in the months leading up to Election Day for updated information. If you have questions, please call 311 and ask to be connected to the Regional Clerk’s Office. Please note that we cannot provide advice on how to conduct an election campaign.

Before beginning a campaign, candidates should familiarize themselves with the Municipal Elections Act, 1996 (external link) and its regulations, the Municipal Act, 2001 (external link), and all other relevant legislation. Candidates are responsible to ensure they have complied with election regulations and are qualified to run for the office of Regional Chair.

Endorsement of Nominations (Form 2)

Candidates running for office must complete an Endorsement of Nomination Form (PDF file) which includes the signatures of 25 individuals who are Canadian citizens, 18 years of age or older, and have a qualifying address in the municipality. Candidates running for Regional Chair may obtain signatures of individuals who have qualifying addresses in the City of Burlington, Town of Halton Hills, Town of Milton or Town of Oakville.

Third Party Advertisers

Third party advertising refers to advertisements or other materials that support, promote or oppose a candidate, or support, promote or oppose a “yes” or “no” answer to a question on the ballot. Third party in this context is a person or entity who is not a candidate. Prior to 2018, third party advertising was not regulated for municipal elections. Recent changes to the Municipal Elections Act, 1996 (external link) require that third party advertisers register prior to conducting any campaign activity.

If you wish to conduct third party advertising for the election for Regional Chair, you cannot register with the Clerk of the Region. You must register with the clerks of the Local Municipalities (City of Burlington, Town of Halton Hills, Town of Milton and/or Town of Oakville) in which you wish to run your advertisements. Please refer to the guide published by the Province of Ontario for third party advertisers for further information.

Candidate Information

Term of Office

The Term of Office is December 1, 2018 to November 14, 2022.

Eligibility

A person is entitled to be a candidate in the 2018 Municipal Election if they are a qualified voter. A candidate must be qualified as of the day they are nominated and must remain qualified throughout the election period and, if elected, throughout the term of office.

A person is entitled to be a candidate if they are:

  • a resident of the Regional Municipality of Halton (i.e. a resident of the City of Burlington, the Town of Halton Hills, the Town of Milton or the Town of Oakville), or an owner or tenant of land in the Regional Municipality of Halton, or the spouse of such an owner or tenant;
  • a Canadian citizen;
  • at least 18 years old;
  • not an employee of the Regional Municipality of Halton (if you are, and wish to be a candidate for Regional Chair, you must take an unpaid leave of absence from your employment with the Regional Municipality of Halton); and
  • not prohibited from voting by law.

If you were a candidate in the 2014 Municipal Election and did not complete your financial filings for that campaign as required by the Municipal Elections Act, you are ineligible to be a candidate in the 2018 Municipal Election.

The Nomination Process

  • A candidate can register a nomination for the Office of Regional Chair by filing a Nomination Form (Form 1) (PDF file) and Endorsement of Nomination Form (Form 2) (PDF file) at the Regional Clerk’s Office, Halton Regional Centre, Level 3, 1151 Bronte Road, Oakville (view map) , starting on Tuesday, May 1, 2018, from 8:30 a.m. to 4:30 p.m. The Nomination Forms (Forms 1 and 2) must be filed by the candidate in person, or by an agent acting on the candidate’s behalf. The candidate or the agent will be required to provide proof of identity.
  • The Nomination Forms may not be faxed, sent by mail, emailed or submitted through any form of social media, as original signatures are required on all election documents filed with the Regional Clerk. The Nomination Forms and Declaration of Qualifications must be signed before a Commissioner of Oaths. The Regional Clerk or another member of the Clerks’ staff can commission these documents for you.
  • If the Nomination Forms are filed by an agent of the candidate, the forms must be fully completed by the candidate prior to filing. The Nomination Forms and Declaration of Qualifications must be signed before a Commissioner of Oaths.
  • The Nomination Forms (Forms 1 and 2) can be picked up at the Regional Clerk’s Office, or are available online. The final day to file Nomination Papers is July 27, 2018 between 9 a.m. and 2 p.m.
  • While a Nomination may be filed any time during business hours between May 1 and July 27, you may wish to make an appointment with the Regional Clerk to submit your Nomination Forms to ensure that the process runs smoothly.

Endorsement of Nomination (Form 2) – Additional Information

  • If you are running for Regional Chair, you must submit 25 signatures endorsing your nomination on Form 2. Anyone providing an endorsement signature on Form 2 must be eligible to vote in the municipality on the day that they signed the endorsement. As part of Form 2, they are required to sign a declaration that they are eligible to vote in the municipality.
  • If you submit 25 endorsement signatures and find out later that a person (or persons) was not eligible to vote on the day that they signed the endorsement, you will not lose your nomination. The person who supplied false information (by declaring that they were eligible to endorse your nomination when they were not eligible) could be subject to prosecution.

Nomination Filing Fee

  • Candidates for Regional Chair must pay a filing fee of $200 when they file their Nomination Forms. This fee must be paid at the time of filing by cash, debit, certified cheque or money order. Credit cards and personal cheques will not be accepted.
  • The nomination filing fee is refundable if the nomination is withdrawn, if the candidate is elected, or if he or she receives more than two (2) per cent of the votes cast in the election for the office of Regional Chair.

Required Identification

  • A candidate must provide one valid and original item from the following list that shows name, qualifying address and signature when filing a Nomination Form:
    • Ontario driver’s licence
    • Cancelled personalized cheque
    • Mortgage, lease or rental agreement for property in Ontario
    • Loan or financial agreement with a financial institution
    • Insurance policy
    • Document issued or certified by a court in Ontario
    • Any other document from the government of Canada, Ontario or a municipality in Ontario or from an agency of such a government
    • Any document from a Band Council in Ontario established under the Indian Act (Canada) (external link)
    OR
  • A candidate must provide one original and valid item from the following list that shows name and signature:
    • Ontario health card
    • Ontario motor vehicle permit (plate portion)
    • Canadian passport
    • Certificate of Canadian Citizenship
    • Certificate of Indian Status
    • Veterans Affairs Canada Health Card
    • Social insurance number card
    • Old age security card
    • Credit card
    • Debit card
    • Employee identification card
    • Student identification card issued by a post-secondary institution
    • Union identification card or a professional licence card

Forms to File

Withdrawal of Nomination

A candidate who wishes to withdraw a nomination must file a Withdrawal of Nomination Form (PDF file) with the Regional Clerk before 2 p.m. on Friday, July 27, 2018. The candidate must file the withdrawal in person and may be required to submit identification. The candidate will still be required to submit a financial statement (due no later than March 29, 2019 at 2 p.m.) covering all financial transactions up to the time of withdrawal.
