Joint Agency Review Team Report (February 2009)

The following report was prepared by JART to inform the public about the team's findings.

The report details the application process, advises on outstanding issues related to the technical submissions and indicates which issues have been dealt with.

Target Dates

The following tentative dates have been set by the Joint Board:

  • February 19, 2009 - Public Information Centre for JART Report.
  • March 2009 - Conservation Halton staff report and Board position.
  • April 2009 - City of Burlington planning report and Council position.
  • May 2009 - Region of Halton planning report and Council position.
  • June 2009 - NEC planning report and Commission position.

Other dates set (for the purpose of advising the Joint Board on the status of the public agencies' timetables) are as follows:

  • March 3, 2009 - Teleconference for update on JART Report progress and dates for future pre-hearings.
  • March 25, 2009 - Teleconference to hear motions regarding other matters to be dealt with as part of the Nelson hearing.

Application Updates

February 29, 2012 - Joint Board Hearing closes. A decision by the Joint Board is pending.

October 26, 2010 - Joint Board Hearing begins. Time and location to be announced.

January 27, 2009 - Teleconference with the Joint Board regarding Regional Official Plan Amendment 25 (ROPA 25) and jurisdictional issues.

December 8, 2008 - A pre-hearing was held at Regional Headquarters regarding the Nelson appeals. The members of the Joint Board panel were Toby Vigod and Alan Levy (Environmental Review Tribunal) and Colin Hefferon (Ontario Municipal Board). Parties to the hearing include the NEC, Region of Halton, City of Burlington, Conservation Halton, Ministry of Natural Resources, Protecting Escarpment Rural Land (PERL), Lake Ontario Water Keeper and Paletta International. CONE and POWER requested Participant status. A number of individual members of the public were granted Presenter status.

It was brought to the Joint Board's attention that matters regarding Regional Official Plan Amendment 25 (ROPA 25) were outstanding and that the policy dealing with the definition of significant woodlands, which were appealed by Nelson and others and subsequently deferred, would need to be addressed prior to the commencement of the hearing of the Nelson quarry appeal.

June 26, 2008 - The Ministry of Natural Resources submitted a letter referring the Nelson Aggregate Co. application to the OMB to address outstanding concerns related to the proposed license application under the ARA.

June 18, 2008 - Nelson filed appeals of their applications, and the Consolidated Board scheduled a pre-hearing for December 8, 2008 to identify the parties, discuss hearing dates and identify issues related to the applications.

May 12 2008 - Nelson Aggregates referred their application to amend the Region of Halton Official Plan and City of Burlington Official Plan to the Ontario Municipal Board for a hearing. May 5, 2008 - Nelson Aggregate Co. launched an appeal to the OMB citing council's lack of decision regarding their applications to amend the Regional and City of Burlington Official Plans as well as the Niagara Escarpment Plan.

March 7, 2008 - Nelson prepared a response to the objections to their application for a License. (The Aggregate Resources Act process concluded on May 17, 2008.)

Additional Information

The proposed quarry is located on part of Lots 17 and 18, Concession 2.

The application is for unlimited yearly tonnage and would use the existing crushing, storage, asphalt recycling and office facilities of the existing quarry to the north.

The new quarry requires a Niagara Escarpment Plan Amendment, Halton Region Official Plan Amendment, City of Burlington Official Plan Amendment, and a Ministry of Natural Resources Aggregate License.

For aggregate applications in the Region of Halton, a Joint Agency Review Team (JART) is set up to review, analyze and comment on the completeness of technical submissions. The JART for this application includes the Niagara Escarpment Commission, the Region of Halton, the City of Burlington, Conservation Halton and the Ministry of Natural Resources.
