Official Contest Rules

Please read these official contest rules (these “Rules”) in their entirety before entering the Halton Region Pumpkins to Pastries Selfie Contest (the “Contest”). By participating in the Contest you accept and agree to these Rules, which are final on all matters relating to the Contest, and any decisions made under these Rules by The Regional Municipality of Halton (“Halton Region”). Halton Region reserves the right to modify, amend, suspend or terminate this Contest, without prior notice, with no obligation or liability.

Eligibility

No purchase is necessary to enter the Contest.

The Contest is open to all residents of Ontario who are 18 years of age or older at the time of entry, except Halton Region employees and council members, owners of establishments participating in the Halton Region Pumpkins to Pastries Trail, and members of their respective households.

Contest period

The Contest starts on Monday, September 18, 2017 at 12:01 a.m. ET and ends on Sunday, October 29, 2017 at 11:59 p.m. ET (the “Contest Period”).

The Contest Period is divided into six (6) weeks as follows:

  • Week 1: September 18 – September 24
  • Week 2: September 25 – October 1
  • Week 3: October 2 – October 8
  • Week 4: October 9 – October 15
  • Week 5: October 16 – October 22
  • Week 6: October 23 – October 29

How to enter

In order to participate, a person entering the Contest (“Contestant”) must:

  • Set their social media privacy settings to “Public”
  • Submit one (1) or more photos, each taken at a different participating trail location listed on the Halton Region Pumpkins to Pastries Trail Map available on halton.ca/p2ptrail, at the Halton Regional Centre or any of the participating trail locations (the “Trail Locations”), up to a maximum of five (5) photos per week of the Contest Period
  • Mention the Trail Location where the photo was taken
  • Ensure that each photo includes something recognizable about the Trail Location where it was taken (such as the Trail Location’s sign) or a featured item or at one of the designated photo (“selfie”) spots from the Trail Location

While some Trail Locations charge an entry fee, participating in the Contest does not require visiting those locations.

Photos can be submitted during the Contest Period via Facebook, Instagram or Twitter and must include the hashtag “#p2ptrail”using an account that is set to ‘public’ from the time of submission until at least November 1, 2017, and must include the name of the Trail Location where they were taken. Photos submitted to the Contest constitute entries (“Entries”).

Halton Region is not responsible for technical problems related to the submission or posting of photos in connection with the Contest.

Entries

Entries that cannot be viewed, do not satisfy the Contest requirements or are determined by Halton Region to be inappropriate will be disqualified. Entries generated by script, macro or other automated means and Entries by any means which subvert these Rules are void.

Winning Contestants grant to Halton Region an unlimited, royalty-free and irrevocable, right and license to use, reproduce, display, post and/or broadcast their Entries in any form, media or technology now known or later developed, including but not limited to Halton Region social media channels, its website (halton.ca) and printed materials. Winning Contestants further waive any copyright that they may have in their Entries. Winning Contestants represent and warrant that they own and control all rights in and to their Entries have the right to grant the foregoing rights to Halton Region.

Collection and use of information

Halton Region will review submitted photos only for the purpose of determining winners for this Contest.

Contestants that submit photos containing more than one identifiable individual must ensure that they have received the consent of those individuals, or are otherwise permitted to consent their behalf (e.g. parent/legal guardian of minors), for the submission and use of their image(s) as part of the Contest.

Contestants agree to Halton Region communicating with them through their social media handle if they are determined to be a winning Contestant. Additional personal information may be collected from the winning Contestants in order to award the prize. Only winning Contestants’ photos will be used for publicity purposes relating exclusively to the Contest. Winning Contestants whose photos contain other identifiable individuals will be required to provide proof of consent for the submission of the photo and Halton Region’s use of the image in accordance with the Contest rules. If such consent cannot be provided upon request, the winning Entry may be deemed to be disqualified.

The collection and use of Contestants’ personal information is in accordance with section 11 of the Municipal Act, 2011, S. O. 2011, c. 25. Prizes

One prize will be awarded each week of the Contest. Each prize will consist of a gift basket including items from participating Trail Locations with an approximate value of $100 to $150.

Prizes are non-transferable and must be accepted as awarded, without substitution.

Winner selection and notification

One Entry will be selected by random draw conducted by Halton Region each week of the Contest. The odds of winning depend on the total number of Entries received.

There is a limit of one prize per Contestant throughout the Contest Period.

Halton Region will notify winning Contestants by social media using the social media network and “handle” used to submit the Entry. The winning Entries for each week of the Contest will be announced on Halton Region’s website (halton.ca), Facebook, Twitter and Instagram on the following dates:

  • Week 1: September 26
  • Week 2: October 3
  • Week 3: October 10
  • Week 4: October 17
  • Week 5: October 24
  • Week 6: November 1

Claiming prizes

In order to claim their prize, winning Contestants must respond to the notification from Halton Region and attend at Halton Region’s offices at 1151 Bronte Road in Oakville, Ontario at a mutually agreed date and time within thirty (30) days of being notified that they have won. Winning Contestants are also required to correctly answer a time-limited mathematical skill testing question in order to receive the prize.

General

Halton Region, its employees, council members, agents, successors and assigns will not be held responsible for any costs, losses, damages, expenses or claims arising in any way in connection with the Contest.

This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, or Instagram. Contestants understand and agree that they are providing their information to Halton Region and not to Facebook, Twitter or Instagram but that any ongoing retention of posted information may also be governed by the terms and conditions set out by the applicable social media site.

This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited.

This Contest and the terms and conditions contained in these Rules will be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder will be adjudicated solely in the applicable court in Toronto, Ontario, Canada.
