Expropriations Act, R.R.O. 1990, Reg. 363
IN THE MATTER OF AN APPLICATION by The Regional Municipality of Halton for approval to expropriate lands in the Town of Halton Hills, in the Region of Halton as described in Schedule “A” set out herein, being:
- Fee simple interests (“Fee Simple”)
- In the case of the Limited Interests in Perpetuity (Permanent Easement – Hydro) for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purposes of facilitating the construction, installation, maintenance and repair of public utilities and/or telecommunication infrastructure including, without limitation, aerial and/or subsurface hydro lines, tiebacks, poles, anchors, guywires, swaying and swinging of overhead hydro lines and associated materials and equipment including utility relocation and site grading ancillary and/or necessary for the Trafalgar Road Reconstruction, and works ancillary thereto. (“Permanent Easement – Hydro”)
- In the case of the Limited Interests in Perpetuity (Permanent Easement – Private Septic and Hydro) for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purposes of facilitating a) the modification, alteration and repair of private septic system; and b) the construction, installation, maintenance and repair of public utilities and/or telecommunication infrastructure including, without limitation, aerial and/or subsurface hydro lines, tiebacks, poles, anchors, guywires, swaying and swinging of overhead hydro lines and associated materials and equipment including utility relocation and site grading ancillary and/or necessary for the Trafalgar Road Reconstruction, and works ancillary thereto. (“Permanent Easement – Private Septic and Hydro”)
- In the case of the Limited Interests in Perpetuity (Permanent Easement – Hydro and Hydro Access Road) for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purposes of facilitating the construction, installation, maintenance and repair of public utilities and/or telecommunication infrastructure including, without limitation, aerial and/or subsurface hydro lines, tiebacks, poles, anchors, guywires, swaying and swinging of overhead hydro lines and associated materials and equipment including utility relocation, construction and/or relocation of the hydro access road, and site grading ancillary and/or necessary for the Trafalgar Road Reconstruction, and works ancillary thereto. (“Permanent Easement – Hydro and Hydro Access Road”)
- In the case of the Limited Interests in Perpetuity (Permanent Easement – Hydro and Watermain) for the purposes of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purpose of site works on, upon, under, over, and through the lands for and in connection with facilitating the construction, installation, inspection, testing, verification, repair, replacement and/or operation of municipal underground sewers, underground water lines, drains, drainage courses, beddings, pipes, conduits, markers, channels, ducts, valves, valve chambers, fittings, meters, hydrants, manholes, services, fixtures, equipment and other associated works and appurtenances or accessories thereto whether or not similar to the foregoing in relation to the transfer, transmission, control, flow, carriage, conveyance, transportation, increasing or decreasing velocity or volume of municipal sewage or water or both, and for all things necessary or incidental thereto including physical modification to the lands through site clearing, building demolition, improvements removal or reconstruction, underground tunnelling, digging, grading, ditching, trenching, filling or otherwise, as well as, to enter and occupy the lands with all necessary vehicles, machinery, equipment, workmen, and other materials required for or related to the Trafalgar Road Reconstruction and works ancillary thereto, and for the maintenance and repair of public utilities and/or telecommunication infrastructure including, without limitation, aerial and/or subsurface hydro lines, tiebacks, poles, anchors, guywires, swaying and swinging of overhead hydro lines and associated materials and equipment including utility relocation and site grading ancillary and/or necessary for the Trafalgar Road Reconstruction and works ancillary thereto (“Permanent Easement – Hydro and Watermain”)
- In the case of the Limited Interests in Perpetuity (Permanent Easement – Track Diversion) for the purposes of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all authorized users, including, but not limited to, servants, agents, employees, contractors, sub-contractors, conductors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, along and upon the lands for the purposes of the construction, re-construction, alignment, diversion, relocation, removal, installation, repairs, maintenance and operation of tracks, signals, platforms, stairs, tunnels, elevators, railway bridges, spurs, pedestrian bridges, noise walls, retaining walls, tiebacks, grade separations, telecommunication, traction power equipment, facilities together with any and all other associated facilities, site investigations including geotechnical, archaeological and design investigations, which the Region deems necessary, with all site grading, clearance including but not limited to the removal of trees, shrubs, bushes, branches, stumps and roots and prevention or control of growth of same, relocation, reconstruction or demolition of buildings necessary for the works to be performed (collectively, the “Works”) together with the operation and passing over and through the easement lands with trains during the duration of this easement. This easement is in common with others, except that during the exercise of this easement from time to time, the Region may, in its sole discretion and upon notice to the owner of the lands subject to this easement (except in the case of emergency), temporarily restrict access to all or part or parts of the lands subject to this easement as a safety measure for such period or periods of time as may be necessary or advisable to permit the performance of the Works. (“Permanent Easement – Track Diversion”)
- In the case of the Temporary Limited Interests (Temporary Easement – Construction and Grading 5-year) for the purpose of a free, uninterrupted and unobstructed temporary easement in gross or rights in the nature of a temporary easement in gross commencing on April 1, 2028 and terminating five (5) years from said commencement date for the purpose of entering upon and occupying the land with all necessary personnel, vehicles, machinery, equipment and material required to facilitate driveway, drainage, grading and/or general construction works necessary or related to the Trafalgar Road Reconstruction, and works ancillary thereto. (“Temporary Easement – Construction and Grading 5-year”)
- In the case of the Temporary Limited Interests (Temporary Easement – Construction and Grading 3-year) for the purpose of a free, uninterrupted and unobstructed temporary easement in gross or rights in the nature of a temporary easement in gross for a term of three (3) years commencing on the date of registration of the plan of expropriation for the purpose of entering upon and occupying the land with all necessary personnel, vehicles, machinery, equipment and material required to facilitate site investigations, including geotechnical, archaeological and design investigations, driveway works, drainage, grading and/or general construction works necessary or related to the Trafalgar Road Reconstruction, and works ancillary thereto. (“Temporary Easement – Construction and Grading 3-year”)
- In the case of the Temporary Limited Interests (Temporary Easement – Construction and Grading 8-year) for the purpose of a free, uninterrupted and unobstructed temporary easement in gross or rights in the nature of a temporary easement in gross for a term of eight (8) years commencing on the date of registration of the plan of expropriation for the purpose of entering upon and occupying the land with all necessary personnel, vehicles, machinery, equipment and material required to facilitate site investigations, including geotechnical, archaeological and design investigations, driveway works and drainage, grading together with the modification, alteration and repair of private septic system and/or general construction works necessary or related to the Trafalgar Road Reconstruction, and works ancillary thereto. (“Temporary Easement – Construction and Grading 8-year”).
registered in the Land Registry Office for the Land Titles Division of Halton (No. 20), for the municipal purpose of facilitating the reconstruction and widening of Trafalgar Road (Regional Road 3) from 10 Sideroad to Highway 7 in the Town of Halton Hills together with utility and ancillary works associated thereto (the “Trafalgar Road Reconstruction”).
NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate the interests herein described in the lands described herein.
Any owner of lands in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing:
- in the case of a registered owner, served personally or by registered mail within thirty (30) days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty (30) days after the first publication of the notice;
- in the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.
