In the matter of an applicatoin by The Regional Municipality of Halton for approval to expropriate lands in the Town of Halton Hills, in the Region of Halton as described in Schedule “A” set out herein, being:
- All Rights, Title and Interests (“Fee Simple”)
- Limited Interests in Perpetuity (“Permanent Easement – Culvert”) for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by any public authority together with all Authorized Users, including but not limited to, servants, agents, employees, contractors, sub-contractors and workers thereof, with all necessary material, including but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the subject lands for the municipal purpose of constructing, installing, keeping, operating, maintaining, inspecting, patrolling, altering, moving, replacing, reconstructing, enlarging, extending and repairing municipal storm works, sewers, drains, drainage courses, drainage swales, beddings, pipes, conduits, footings, culvert pipes, culvert structures, grates, markers, channels, ducts, manholes, catch basins, ditch inlets, headwalls, services, fixtures, inlet/outlet works, erosion control measures, sediment control devices, slope stability works, vegetation, equipment, and other works and appurtenances or accessories thereto whether or not similar to the foregoing, as may be useful or convenient in connection therewith or incidental thereto, for the purposes of the transfer, transmission, control, flow (whether increase or decrease), carriage, conveyance, transportation, increasing or decreasing velocity or volume of water, both above and below the ground or partly of each, and for all purposes and things necessary for or incidental to the exercise and enjoyment of the rights hereby created necessary or related to the Winston Churchill Reconstruction and Improvements Project, and works ancillary thereto.
- Limited Interests in Perpetuity (“Permanent Easement – Hydro Tiebacks”) for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by any public authority together with all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub- contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purposes of facilitating the construction, installation, maintenance and repair of public utilities and/or telecommunication infrastructure including, without limitation, aerial and/or subsurface hydro lines, tiebacks, poles, anchors, guywires and associated materials and equipment including utility relocation and site grading ancillary and/or necessary for the Winston Churchill Reconstruction and Improvements Project, and works ancillary thereto.
- Temporary Limited Interest (“Temporary Easement – Driveway Works and General Construction”) for the purpose of a free, uninterrupted and unobstructed temporary easement in gross or rights in the nature of a temporary easement in gross for a period of three (3) years commencing April 1, 2025 for the purpose of entering upon and occupying the land with all necessary personnel, vehicles, machinery, equipment and material required to facilitate driveway, drainage, grading and/or general construction works necessary or related to the Winston Churchill Reconstruction and Improvements Project, and works ancillary thereto.
Registered in the Land Registry Office for the Land Titles Division of Halton No. (20), for the municipal purpose of facilitating the reconstruction and improvement of Winston Churchill Boulevard (Regional Road 19) from The Credit River to approximately 150 metres south of 17 Side Road, in the Town of Halton Hills together with utility and ancillary works associated thereto (the “Winston Churchill Reconstruction and Improvements Project”).
Notice is hereby given that application has been made for approval to expropriate lands and interests described in Schedule “A” set out herein.
Any owner of lands in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,
- in the case of a registered owner, served personally or by registered mail within thirty (30) days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty (30) days after the first publication of the notice;
- in the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.
A copy of the reference plans referred to herein are available for viewing at the Clerk’s Office of The Regional Municipality of Halton at 1151 Bronte Road, Oakville, Ontario L6M 3L1 during regular business hours.
